Patna High Court MJC No.1433 of 2018(5) dt.07-12-2022 2/3 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 07-12-2022 The petitioner has prayed for the following relief/s :- "For initiation of proceeding under the Contempt of Court's Act for willful violation of the order dated 29.03.2016 passed by Hon'ble Mr. Justice Shivaji Pandey in C.W.J.C. No. 6104/2013 (Sumitra Kumari @ Sumitra Devi Vrs. the State of Bihar & Ors.) by which the Hon'ble Judge has directed that after setting aside the order of the Collector dated 9/2/2012 passed in Misc. Case No. 40/2008-09 as well as the order of Commissioner dated 5/2/2013 passed in service Appeal No.25/2012 matter is remanded to the Collector to decide the case of the present petitioner after giving proper opportunity of hearing to Suman Bharti, the Collector will complete its process within a period of 6 months from the date of receipt /production of this order."

Having heard learned counsel for the parties, this Court is of the considered view that with the passing of the order dated 13.06.2017 (Annexure-A, Page -14) along with response to the show cause, directions contained in the order dated 29.03.2016, passed by this Court in CWJC No. 6104 of 2013, titled as Sumitra Kumar @ Sumitra Devi Vs. the State of Bihar and Ors. stands complied with.

As such, there is no question of the opposite parties having violated the order passed by this Court or committed any contempt.

Accordingly, the instant application stands disposed
