The petitioners seek bail in connection with Belaganj P.S. Case No. 113 of 2023 dated 23.02.2023 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 325 and 307 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added; Section 25(1-B) a/35 of the Arms Act and 3/4 of the Explosive Substance Act. The allegation against the petitioners is that they entered the village, on a Scorpio vehicle, with an intention to

Learned counsel for the petitioners submits that there is no eye witness to the occurrence and there is no specific allegation against them. The petitioners have no criminal antecedent and they have been falsely implicated in this case. They are in judicial custody since 01.03.2023 and have themselves surrendered in the Court. Learned counsel further submits that charge sheet has already been submitted against the petitioners.

Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Gaya in connection with Belaganj P.S. Case No. 113 of 2023.
