JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner happens to be husband of the deceased and one witness namely, Ruby Kumari, who happens to be younger sister of the deceased, claimed herself to be eye witness of the alleged occurrence. The aforesaid witness, specifically, stated that the petitioner along with his other family members

Patna High Court Cr.Misc. No.16210 of 2015 (4) dt.10-09-2015 2/2 went to see dance and petitioner did not allow the deceased to accompany them and when they returned, a quarrel took place between the petitioner and the deceased and in that course, due to sudden provocation, petitioner started assaulting the deceased by fist and slaps as a result thereof, the deceased died then and there. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case N. 07 of 2013.
