The petitioner, Akber Mian, who is in custody since 02.09.2013 in Manjhi P.S. Case No.72 of 2009 under Section 392 of IPC.

The case of the prosecution is that motor cycle was stolen away.

The learned counsel for the petitioner submitted that nothing has been recovered from the possession of the petitioner and still today no T.I. pared has been held.

Considering the nature of allegation and the fact that the petitioner is in custody since 02.09.2013, I direct that the
