Petitioner seeks bail in connection with Alamganj P.S. Case No. 121 of 2015 registered for the offence punishable under Sections 302/24 of the Indian Penal Code.
The petitioner is not named in the first information report but during course of investigation FIR named accused Vicky confessed his guilt and it transpires that the petitioner being the mother of Vicky gave order to kill Devkunj @ Santu. Submission is of false implication and that the alleged confessional statement of co-accused has got no evidentiary value in the eye of law, other co-accused Gyandip Kumar and Mantu Chaudhary have already been allowed bail vide Cr.Misc. No. 56816 of 2015 and 54343 of 2015 by another co-ordinate Bench of
Patna High Court Cr.Misc. No.6827 of 2016 (2) dt.01-03-2016 this Court and the petitioner being lady is suffering in custody since 29.10.2015 having no criminal antecedent. Learned APP submits that the trial is in progress. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Patna City in S. T. No.913 of 2015 arising out of Alamganj P.S. Case No. 121 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on her part without any reason shall disentitle the petitioner from privilege of bail.
