JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER -02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Three cartridges and rifle, one Katta and one magazine are said to have been recovered from the house of the petitioner No. 1 and petitioner No. 2 was found sitting in the house of petitioner No. 1.

Admittedly, nothing was recovered from conscious possession of petitioners.

No doubt, both petitioners do carry criminal antecedent but taking into consideration the above-said facts and circumstances as well as this aspect of the matter that petitioners

Patna High Court Cr.Misc. No.5234 of 2016 (2) dt.12-02-2016 are in jail custody since 22-10-2015, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Gopalpur P.S. Case No. 142 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran.
