In huge quantity wheat and empty bags of FCI were recovered from rice mill and petitioners were caught on the spot while they were trying to flee from the said rice mill. Petitioners disclosed that they were employees of the aforesaid rice mill. Submission on behalf of the petitioners is that empty bags of FCI are available in open market and there is no control in respect of wheat.

Moreover, petitioners do not have any concern with the aforesaid rice mill and are languishing in jail custody since 6.1.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on

Patna High Court Cr.Misc. No.5583 of 2016 (2) dt.15-02-2016 furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Thawey P.S. Case no. 01/2016.
