The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a),38,41 of the Bihar Prohibition and Excise Act, 2016. The name of the petitioner surfaced in the statement of co-accused. According to the statement of co-accused, whatever allegation relating to excise matter is there against the petitioner was committed in the State of Haryana and not in the State of Bihar. Therefore, no offence under the Bihar Prohibition and Excise Act ,prima facie, is made out.

Considering the nature of allegation, let the above named petitioner be released on anticipatory bail in the event of

No.40031 of 2019(6) dt.24-01-2020 2/2 his arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/-(twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.II-cumSpecial Judge, Buxar in connection with Economic Offence Unit Patna Case No.17 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also that both bailors shall be resident of territorial jurisdiction of the learned court below.
