2. The petitioner seeks bail in connection with Khajekalan P.S. Case No. 308 of 2023 registered for the offence under Sections 302, 120B, 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. The petitioner is the assailant of the deceased and is named in the FIR. The witnesses have also supported the crime.

4. Learned counsel for the informant have opposed the application of the petitioner for grant of bail and has undertaken to produce the witnesses on the dates fixed.

5. Considering the fact that the petitioner is the assailant of the deceased, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest. If the trial is delayed due to the fault of the prosecution side then the petitioner may renew his prayer for bail.
