Case No.90 of 2013 was registered against him. The petitioner was arrested on 18.1.2014. The petitioner filed B.P. No. 17285/14, in the court of learned 7th Additional Sessions Judge, Patna. The learned Judge dismissed the same through order dated 11.3.2014. Hence, this application for grant of bail under Sections-439 and 440 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The allegation against the petitioner is, no doubt, serious. The fact, however, remains that the petitioner is in jail for more than two and a half years

Patna High Court Cr.Misc. No.28634 of 2014 (3) dt.13-04-2015 2/2 and by this time the investigation may have been completed. Even if any part of the investigation is incomplete, the detention of the petitioner is not necessary. This Court is inclined to grant bail. The application is allowed.

The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Patna in connection with Hawai Adda P.S. Case No.90/2013 (G.R. No.3355/2013), subject to the conditions that he shall report to the police on the 1st and 3rd Saturday of every month in the police station between 9:00 and 10:00 a.m.. In case the petitioner fails to appear on two consecutive occasions during the trial, the bail shall stand cancelled.
