JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-02-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner seeks bail in connection with Atari P.S. Case No. 107 of 2015 registered for the offences punishable under Sections 341, 323, 326, 307, 504 and 302 of the Indian Penal Code.

Allegedly, the petitioner burnt Kanti Devi after assaulting her and thereafter fled away. During treatment Kanti Devi died.

Submission is of false implication and that the prosecution story appears not probable and reliable, Kanti Devi the wife of the petitioner was burnt due to burst of stove and the informant who is elder brother due to inimical term implicated the petitioner, resulting, he is suffering in custody since 15.07.2015 to

Patna High Court Cr.Misc. No.6592 of 2016 (2) dt.26-02-2016 which learned APP seriously opposes.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner serious in nature, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected. However, considering the period of detention, trial court is directed to expedite the trial and conclude the same as early as possible.
