The petitioner is apprehending his arrest in connection with Siwan Mufassil P.S.Case No.594 of 2017 registered for offences punishable under Sections 413 and 414 of the Indian Penal Code.

Allegation as per FIR is that one stolen motorcycle was recovered from the possession of one co-accused, Saddam Hussain and he disclosed the name of the petitioner who has given the stolen motorcycle to him as he is engaged in the theft and other crime.

Submission of the learned counsel for the petitioner is that he has been made accused only on the basis of confession and there is nothing against him.

Heard learned A.P.P. , who has opposed the prayer for bail

Patna High Court CR. MISC. No.31278 of 2019(5) dt.02-08-2019 2/2 on the ground of nature of allegation as well as the fact that the investigation is still going on.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid direction, this application is dismissed.
