15-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Katoriya P.S. Case No. 99 of 2017, registered for the offence under Sections 30(a) and 32(2) of Bihar Prohibition and Excise Act.

104 liters of illicit foreign liquor has been recovered from a car, of which, this petitioner is registered owner. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent and he is in custody since 20.08.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, period of custody and clean antecedent of petitioner, the bail petition of

Patna High Court CR. MISC. No.35322 of 2020(4) dt.15-11-2021 2/2 petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge, Banka in connection with Katoriya P.S.
