Prayer of the Petitioner for bail was earlier rejected by this Court by order dated 01.05.2013 passed in Cr. Misc. No.2825 of 2013.

Perused the report of the Sessions Judge, Muzaffarpur, from which it appears that now the case has been transferred to the Court of the 11th Additional Sessions Judge, Muzaffarpur, who has, in turn, reported that the witnesses are being examined.

The report of the Sr. Superintendent of Police, Muzaffarpur, is to the effect that his agency is conscious with regard to examination of the witnesses and they are being produced regularly.

In such circumstances and in view of nature of

Patna High Court Cr.Misc. No.21793 of 2014 (5) dt.15-04-2015 2/2 allegation, I am not inclined to review the earlier order refusing bail to the Petitioner.

Prayer of the Petitioner for bail in connection with Sessions Trial No. 105 of 2013 arising out of Sakra P.S. Case No.156 of 2012 pending before the 6th Additional Sessions Judge, Muzaffarpur, is once again rejected.

The trial Court is directed to ensure the attendance of the witnesses on the date fixed and take stringent steps against them if they fail to appear including issuance of warrant of arrest and reporting to the higher authorities in its regard. (Anjana Prakash, J) JA/- U T
