The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 376, 511, 379, 504 and 506 of the Indian Penal Code.

The prosecution allegation, in short, is that the petitioner entered into the house and outraged the modesty of his daughter and tried to commit rape upon her. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. From perusal of paragraphs 23 and 24 of the case diary, it appears that the petitioner has falsely been implicated in the present case. The independent witnesses who have been

Patna High Court CR. MISC. No.8619 of 2021(3) dt.17-05-2022 2/2 examined in the above referred paragraphs have categorically stated that no such incidence is said to have taken place. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S.
