Learned counsel for the petitioner submits that the Panchayat Sarkar Bhawan is being constructed on a piece of land which is the subject matter of Title Suit No. 92 of 2023 in which Sumitra Devi is the plaintiff and she claims that the land belonging to her whereas the stand of the State Governemnt is

Patna High Court CWJC No.9766 of 2023(4) dt.26-11-2024 2/2 that the piece of land whereon the Panchayat Sarkar Bhawan is going to be constructed is donated to his excellency Governor of Bihar, as such, the nature of that land is a Gairmazarua Aam. As per circular, a Panchayat Sarkar Bhawan shall be constructed on the Gairmajarua Aam land.

3. Learned counsel for the State has submitted that the plaintiff Sumitara Devi, who might be aggrieved by the construction of the Panchayat Sarkar Bhawan did not file any objection. The petitioner, being a villager, has filed objection. He has no locus standi.

4. The petitioner may raise his grievance before the District Magistrate, who shall decide it in accordance with law.

5. With the aforesaid observations and directions, this writ petition stands disposed of.
