Petitioner is in jail custody since 17.05.2015 on the accusation that he was caught red handed taking bribe of Rs. 50,000/- and earlier his prayer for bail was rejected by this Court vide order dated 30.09.2015 passed in Cr. Misc. No.45862 of 2015.
Submission on behalf of the petitioner is that the
Patna High Court Cr.Misc. No.16616 of 2016 (2) dt.24-08-2016 2/2 charge against the petitioner has already been framed and moreover, petitioner has remained in jail custody for one year. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Special Judge Vigilance Court ( Trap) Bihar, Patna in connection with Special Case No. 21 of 2015, subject to the condition that petitioner shall attend the trial court on each and every date for the period of six months or till conclusion of his trial which ever is earlier and, if he, fails to do so on two consecutive dates, without any reasonable cause, the concerned court shall be at liberty to cancel the bail bonds of the petitioner after due and proper inquiry.
