JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 272, 273, 308 of the I.P.C. and Sections 47(A) and 53(B) of the Bihar Amendment Excise Act, 2016. Allegation is that 945 bottles containing 200 ml each country made wine was recovered from the possession of the accused persons including the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.10.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that 945 bottles containing 200 ml each country made wine is said to have been recovered. There is no compliance of Section 100 Cr.P.C.
Patna High Court Cr.Misc. No.52588 of 2016 (2) dt.14-12-2016 2/2 The alleged recovery is said to have been made from the possession of other co-accused. The petitioner is said to be the owner of the vehicle, on which the wine is said to have been recovered. The petitioner is aged 70 years.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Siwan in connection with Jiradai P.S. case No.46 of 2016.
