The petitioner seeks bail in Dhaka P.S. Case No. 52 of 2014 for the offence under Section 387of the Indian Penal Code.

The informant alleged that he received a letter containing Mobile No. 9504332471. The bearer asked him to talk on the mobile. After two days, he again received a call from Mobile No. 9504691227 and alleged that extortion was being demanded in the name of Maoist.

Learned counsel for the petitioner submits that SIM No. 9504691227 belongs to the petitioner but the same was misplaced in the year 2013. The petitioner did not inform the police due to ignorance. The petitioner has got no criminal

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner has no criminal antecedent and has remained in jail for five months, the petitioner named above is directed to be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Dhaka P.S. Case No. 52 of 2014.
