Petitioner being the husband of the informant is languishing in custody since 10.01.2016 in a case registered for the offences punishable under Sections 498A, 307/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of dowry demand and making assault. It is submitted by the learned counsel for the petitioner that petitioner admits his marriage with the informant on 24.02.2007, thereafter the informant filed Complaint Case No. 478C of 2008 which subsequently ended
Patna High Court Cr.Misc. No.7519 of 2016 (2) dt.16-02-2016 into compromise thereafter the informant resumes the conjugal life and gave birth to a child. Thereafter, again it is alleged that on 23.06.2015 she was being assaulted. It is further submitted that for the same cause of action with same accusation Complaint Case No. 835C of 2015 has also been filed when order of cognizance has been passed.
Considering the nature of accusation, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Sohsarai P.S. Case No. 224 of 2015.
