The petitioner seeks regular bail in connection with Giriyak P.S. Case No. 47 of 2023, registered for the offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and Section 66 (C) and 66 (D) of the I.T. Act. The allegation against the petitioner is that he alongwith other co-accused persons are involved in cheating through mobile and on search two mobile phones and several other documents were seized from the conscious possession of the petitioner.
Learned counsel for the petitioner submits that except the alleged confessional statement of the petitioner there is no incriminating article found against the petitioner. Charge-sheet
Patna High Court CR. MISC. No.34818 of 2023(2) dt.07-07-2023 2/2 has already been submitted and there is no chance of absconding of the petitioner or tampering with the evidence. Petitioner is a student having no criminal antecedent and is in jail custody since 26.01.2023.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Giriyak P.S. Case No. 47 of 2023.
