JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Khagaria P.S. Case No. 925 of 2018, disclosing offence under Section 366 of IPC.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that she has appeared before the court and made statement under Section 164 of Cr.P.C., in which she has stated that she married with the petitioner and wants to reside with him and she disclosed her age 19 years before the court, whereas the Medical Board has found her age in between 16-18 years. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the

No.34301 of 2019(4) dt.02-08-2019 2/2 court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 925 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
