24-03-2021 Heard learned counsel for the parties.

This is 2nd attempt for grant of bail on behalf of petitioner in Special (N.D.P.S.) Case No. 19/2018, arising out of Barari P.S. Case No. 418/2018 (GR No. 4682/2018), registered for the offence under Section 20/22 of N.D.P.S. Act. Earlier, vide order dated 23.10.2019 passed in Cr.Misc. No. 46394 of 2019, the prayer for bail of petitioner was rejected. On last date i.e. on 10.02.2021, a report was called for from the Trial Court regarding stage of the trial, which has been received and kept at flag 'R'. From perusal of the same, it appears that the case is fixed for prosecution evidence and till date, no witness has been examined.

In this case, 198 kg of Ganja was recovered from the back seat of Bolero vehicle and petitioner was found to be sitting on the driver's seat.

Patna High Court CR. MISC. No.32165 of 2020(3) dt.24-03-2021 2/2 Considering the stage of the trial and quantity of recovered Ganja, I am not inclined to grant bail to the petitioner and same is, accordingly, dismissed.
