The petitioner, Md. Minatullah @ Minatullah, seeks regular bail in Darbhanga Sadar P.S. Case No.148 of 2014, registered under Sections 435, later on added 436 of the Indian Penal Code.
The informant lodged the case against unknown for setting ablaze a hut, in which some furniture of Neyaz Ahmad were kept.
Learned counsel for the petitioner submits that initially the case was registered under Section 435 of the Indian Penal Code, but the police submitted charge-sheet under Section 436 of the Indian Penal Code. The burnt hut was not a dwelling house. During the course of investigation some persons saw the
Patna High Court Cr.Misc. No.905 of 2015 (2) dt.09-01-2015 2/2 petitioner fleeing away from the place of occurrence. It appears that the hut, in which some furniture were kept, was burnt to ashes and the same is not a dwelling house. Considering the facts and the nature of allegation made against the petitioner, his prayer for bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S.
