JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to be main assailant and the ferdbeyan of the informant is amount to dying declaration. The learned trial court has reported vide his letter no. 08/2015 dated 03.02.2015 that out of nine proposed prosecution witnesses, two prosecution witnesses have already been examined and to procure the attendance of remaining prosecution witnesses, processes have already been issued.
Considering the aforesaid facts and circumstances, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 593 of 2013
Patna High Court Cr.Misc. No.37574 of 2014 (4) dt.20-04-2015 arising out of Jurawanpur P.S. Case No. 27 of 2010 pending in the court of 1st Additional Sessions Judge, Vaishali at Hajipur stands rejected.
However, it appears that letter no. 08/15 dated 03.02.2015 has been sent by In-charge of 1st Additional Sessions Judge, Vaishali at Hajipur and it is not clear from the aforesaid report as to whether Sessions Trial No. 593 of 2013 is pending in a vacant court or not and, therefore, it is ordered that if the Sessions Trial No. 593 of 2013 is presently pending in a vacant court, the learned Sessions Judge, Vaishali at Hajipur shall ensure the transfer of aforesaid Sessions Trial No. 593 of 2013 to a functional court within a week from the date of receipt/production of copy of this order. It is also made clear that learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within nine months from the date of receipt/production of copy of this order.
