JUSTICE RAKESH KUMAR ORAL ORDER 12-06-2019 Heard Dr. Manoj Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 08-02-2019, as stated in paragraph - 16 of the petition, in Khiri More P.S. Case No. 09 of 2019 registered for offence under Section 414 of the Indian Penal Code and Section 11(i)(D)(E) (F)(G) of Prevention of Cruelty to Animals Act, 1960, has prayed for grant of bail.
At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. It has further been stated by learned counsel for the petitioner that one of the co-accused namely Birju Das has already been extended the privilege of bail by order dated 23-04-2019 passed
Patna High Court CR. MISC. No.31506 of 2019(2) dt.12-06-2019 2/2 in Cr.Misc. No. 26421 of 2019 (Annexure - 3 to the present petition).
Considering the fact that petitioner is having clean antecedent, period of custody as well as the fact that co-accused has been granted bail, there is no reason to further detain the petitioner.
Let the petitioner namely Md. Safik be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - III, Danapur (Patna) in connection with Khiri More P.S.
