JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is father in law whereas rest petitioners are brothers in law of the deceased. No doubt, deceased died within one year of her marriage and there is allegation of demand against the petitioner no. 1 as well as husband of the deceased and furthermore, the death of the deceased was other than normal circumstances.
Petitioners are in jail custody since 13.05.2014 and except petitioner no. 1, there appears to be no specific allegation of torturing as well as demand of dowry against the rest
Patna High Court Cr.Misc. No.40727 of 2014 (6) dt.20-04-2015 petitioners. So far as petitioner no. 1 is concerned, it is argued that he is separate from the husband of the deceased. It is also pointed out that husband of the deceased has already been remanded in judicial custody.
Considering the period of detention of the petitioners in jail custody as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhubani in connection with Jainagar P.S.
