JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kashichak P.S. Case No. 100/2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 18.04.2021, and is a person of clean antecedent and charge-sheet has been submitted, allegation is of recovery of 488 litres of liquor from a Scorpio vehicle as detailed in the F.I.R. alongwith 80 pouches of country

Patna High Court CR. MISC. No.44856 of 2021(2) dt.10-12-2021 2/2 made liquor of Jharkhand brand. Learned counsel further submits that petitioner is not named in the F.I.R. and his name came in the confessional statement of co-accused Baliram Kumar @ Karu Yadav, which does not have any evidentiary value in the eye of law.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 10.06.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J II cum Special Judge, Nawada in connection with Kashichak P.S. Case No. 100/2019.
