The learned counsel for the petitioner has submitted that, though earlier the prayer for bail of the petitioner was rejected, vide order dated 04.07.2024 in Cr.Misc.No.45851 of 2024, but the petitioner is renewing his prayer for bail on the ground that co-accused Nilesh Kumar, in whose confessional statement the name of the petitioner figured, has been granted bail by a Co-ordinate Bench of this Court in Cr.Misc. No. 38909 of 2024. On the basis of the confessional statement of Nilesh Kumar, the stolen articles were recovered from the house of coaccused Guddu Kumar and nothing was recovered from the house or possession of the present petitioner. The petitioner is in custody since 09.01.2024.

3. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VII, Lakhisarai in connection with Barahiya P.S.Case No. 04 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
