The present application has been filed for modification application of order dated 09.01.2023 passed in Cr. Misc. No.52896 of 2022.

Learned counsel for the petitioner submits that during the pendency of the bail application, petitioner no.10 in Cr. Misc. No.52896 of 2022, namely, Nasbul @ Najbul son of Abul has been arrested by the police and while pressing the anticipatory bail application, learned counsel has not pressed the anticipatory bail application of petitioner no.10 but, due to typographical mistake or confusion, it has been typed that "counsel for the petitioners on instruction of his client does not want to press the

Patna High Court CR. MISC. No.46516 of 2023(2) dt.26-07-2023 2/2 application against petitioner no.1 of Cr. Misc. No.52896 of 2022, namely, Naeem in place of petitioner no.10. 4.

Considering the submission of the learned counsel for the petitioner, the order dated 09.01.2023 is modified and petitioner no.1 of Cr. Misc. No.52896 of 2022, namely, Naeem, be released on bail on the conditions as mentioned in the aforesaid order and further the period to surrender is extended by four weeks from today in connection with Raniganj P.S. Case No.113 of 2022, pending in the court of learned C.J.M., Araria, subject to deposit of Rs.2000/- (Rs. Two Thousand) in the Victim Compensation Fund.

Accordingly, the order dated 09.01.2023 is modified to the extent as indicated above and this modification application is allowed.
