Deceased Baleshwar Yadav was taken away by Bijay Singh, Sanjay Mandal, Munmun Singh, Jhotaha Sao, Pramod Mahto, Chandan Singh, Sallu Mandal (petitioner), Shankar Paswan along with 2-3 unknown persons.

After 3-4 hours as he did not return, informant, brother of Baleshwar Yadav along with others came out from their house and at that very time saw a tempo from which, dead body of Baleshwar Yadav thrown away and then the tempo speed away. Informant had identified all those persons to be the occupant of the tempo.

Patna High Court Cr.Misc. No.8493 of 2016 (3) dt.08-04-2016 2/2 Gone through the case diary from which it transpires that none of the witnesses are eye witness save and except corroborating throwing of dead body from tempo having been occupied by petitioner and others.

Accordingly, petitioner Shailendra Kumar @ Sallu Mandal @ Shailendra Kumar Sallu Mandal is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount to the satisfaction of learned Sub-divisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S.
