Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chapra (Town) P.S. Case No. 45 of 2020, registered under Section 379 of the Indian Penal Code.

The accusation is that informant, Abhishek Kumar Sah, is running the plant Nursery in front of the office of ADM in Chapra and two CCTV Camera were installed in the said Nursery. When the informant came in his Nursery in the morning of 22.01.2020 then found that the plants worth

Patna High Court CR. MISC. No.32170 of 2020(2) dt.05-03-2021 2/2 Rs.20,000/- and the CCTV Camera have been stolen. Earlier, the plant were also stolen and on that time, on verifying in CCTV footage, the face of a person was identified, whose name was Ravi Shankar Kumar (petitioner).

Learned counsel for the petitioner submits that it would appear from the FIR that petitioner has falsely been implicated in the present case mere on suspicion without any basis, on pretext that this petitioner was earlier identified through CCTV footage entering in the Nursery of the informant. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra (Town) P.S. Case No. 45 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
