1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Kabaiya Police Station Case No. 33 of 2025, dated 07.02.2025, disclosing offences punishable under Sections 126(2)/115(2)/324(2)/351/352/74/191(2) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, as per the First Information Report, is that on 06.02.2025, while the informant was about to sit in her vehicle near her home, the petitioners and others

2/4 surrounded her, misbehaved with her and tried to outrage her modesty.

Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in this case due to some dispute between the petitioners' group and other group of persons during immersion procession of Goddess Saraswati. The allegation against the petitioners of molestation and damaging the vehicle of the informant is false and fabricated. The First Information Report, bearing Kabaiya Police Station Case No. 32 of 2025, was lodged by the side of the petitioners against the husband of the informant and others, stating herein that the immersion procession of Goddess Saraswati was stopped by the accused persons named in the First Information Report and when objected by the petitioners and others, they started assaulting them with iron rod and they also stopped the vehicle on which the statue of Goddess Saraswati was kept.

The accused persons also damaged the statue of Goddess Saraswati and D.J. etc. The First Information Report lodged by the side of the petitioners is prior in time to the First Information Report lodged by the present informant.

3/4 Reports were lodged for the same occurrence by different persons. The petitioners are having no criminal antecedent prior to lodging of the other three First Information Reports against them on the date of occurrence.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation and the fact that there is case and counter case between the parties and the petitioners have no criminal antecedent prior to lodging of the three other First Information Reports against them on the same date of occurrence, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Kabaiya Police Station Case No. 33 of 2025, subject to the condition laid down

4/4 under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
