The petitioners apprehend their arrest in Belaganj P.S. Case No. 113 of 2019, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 40 litres of country made liquour made of Mahua has been recovered from dickey of one motorcycle and two persons fled away after seeing the police party.

It is submitted on behalf of the petitioners that petitioners have falsely been implicated in this case. Petitioners have no concern with the recovered motorcycle or liquour. Nothing has been recovered from possession of these

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Belaganj P.S. Case No. 113 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
