The petitioner is languishing in custody since 18.05.2013 in a case registered for the offences punishable under Section 387 of the Indian Penal Code.

The accusation is of demanding extortion through mobile.

It is submitted by learned counsel for the petitioner that the mobile from which the extortion demand was made is not registered in the name of the petitioner. Moreover, even assuming the accusation no offence under Section 387 of the IPC is made out. Though, the petitioner is accused in three other cases but he is on bail in those cases.

No.1461 of 2015 (02) dt.15-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Raxaul at Motihari (East Champaran) in connection with Chhauradano P.S. Case No. 35 of 2013.
