The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case in brief is that scooty of the informant, parked outside Biryani Mall, Fraser Road, Patna was found missing.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 16-01-2019. Charge sheet in this case has already been submitted. The petitioner is not named in the FIR. His name transpired in this case on the basis of confessional statement of co-accused. The petitioner has not been put on test identification parade.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 880 of 2018.
