2. The petitioner seeks bail in connection with Barari P.S. Case No. 403 of 2022 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 302, 201, 364, 386, 120B of the Indian Penal Code and Section 27 of the Arms Act.
3. Prosecution case, in short, is that, on 02.12.2022, members of Mohna Thakur gang abducted informant's son, namely, Rahul Kumar Yadav, along with two others, namely, Sonu Kumar and Lalu Kumar Yadav, at gunpoint for refusing to pay Rs. 2,000/- per cattle as rangdaari for grazing. On 06.12.2022, their bullet riddled bodies were found in Kamalpur

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that FIR is registered against 23 named persons and 10-15 unknown persons. Petitioner is not named in the F.I.R. The name of the petitioner transpired in this case during investigation. Learned counsel further submitted that petitioner has no concern with the alleged crime in question and he is not the gang man. No specific overt act is alleged against the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.01.2025 and has two criminal antecedents. Learned counsel further submitted that several co-accused persons have been granted bail by this Court vide Annexure-P-2 Series annexed to the present bail application.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing
Patna High Court CR. MISC. No.32413 of 2025(3) dt.11-07-2025 3/3 bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barari P.S. Case No. 403 of 2022.
