JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.4.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The accusation is of robbing the truck loaded with flour. Subsequently the truck and the flour were recovered from co accused Chandra Mohan Kumar. Name of the petitioner sprang up in the confession of co accused Chandra Mohan Kumar. A supplementary affidavit has been filed that no recovery has been made from the petitioner nor the petitioner has been put on test identification parade till date. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.1462 of 2015 (2) dt.16-01-2015 2/2 satisfaction of learned JM, Motihari, East Champaran in connection with Kotwa P.S. Case No. 65 of 2014. Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
