JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard learned counsel for the petitioner and Shri Lalan Kumar, learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Sultanganj P.S. Case No. 39 of 2021 instituted for the offences under Sections 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 20.02.2021, is a person with clean antecedent and charge-sheet has been submitted in this case. Allegation is that there was some altercation between the parties on account of immersion of Goddess Saraswati and the altercation laid to a free fight and in the said incident husband of the informant died and accordingly the FIR was instituted against 13 named persons including the petitioner and 15-20 unknown persons. There was a free fight between two side as a result of which the husband of the informant on account of assault died. It is further submitted that coaccused Gautam Yadav @ Gautam Kumar has been granted bail by a Coordinate Bench of this Court vide order dated 12.08.2021 passed in Cr. Misc. No. 30157 of 2021 and co-accused Dayanand Yadav has been granted bail by this Court vide order dated 12.01.2022 passed in Cr. Misc. No. 43342 of 2022.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.02.2021, charge-sheet has been submitted and petitioner is a person with clean antecedent and co-accused as aforesaid have been granted bail let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bhagalpur in connection with Sultanganj P.S. Case No. 39 of 2021.
