There is omnibus allegation of assault against the petitioner and other accused but in course of investigation, some witnesses stated that petitioner along with co-accused Md. Bali assaulted the deceased with leg on his chest. Moreover, one co-accused Md. Kari Fakir against whom, there is similar allegation of assault, has already been granted privilege of bail by a coordinate bench of this court vide order dated 20.08.2014 passed in Cr. Misc. no.12088/2014. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Matihani P.S. Case no. 71/2013.
