JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hasanpur P.S. Case No. 40 of 2019 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Case is of recovery of 3 and odd litres of liquor from the house of one Kamal Prasad Singh and petitioner is alleged to be the rental of Kamal Prasad Singh.

Submission of learned counsel for the petitioner is that he is not rental, having no criminal antecedent and he is ready to abide by any condition that may be imposed on him. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this

No.32529 of 2019(2) dt.16-05-2019 2/2 order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur, in connection with Hasanpur P.S.Case No. 40 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation.
