Petitioner being husband of the deceased is in jail custody since 13.5.2014 in a case initially, registered under section 304B/34 of the IPC and 3/ 4 of the D.P. Act but after investigation, police submitted charge sheet under section 306 of the IPC. According to the prosecution case itself, marriage of the deceased had taken place with the petitioner six years ago and her dead body was found in a well. The depth of the well was about 60 feet and at the time of alleged occurrence, there was no water in the said well.

The contention on behalf of the petitioner is that deceased was suffering from tuber closis and being fed up with the above stated ailment, deceased committed suicide.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.51564 of 2014 (4) dt.24-04-2015 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Anand Kumar Singh, Judicial Magistrate, Ist Class,Gaya/concerned court in Delha P.S. Case no. 66/2014.
