Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of IPC. Allegation against the petitioner and others is to have caused the death of the daughter of the informant. It is submitted that after investigation charge-sheet was submitted and the petitioner is facing trial. Up till now seven witnesses including the informant have been examined in this case. P. Ws. 1 to 6 have been declared hostile. P.W. 7 Ram Sewak
Patna High Court Cr.Misc. No.1881 of 2015 (6) dt.20-07-2015 2/2 Sah (informant) has stated that he made statement before the police that his daughter (deceased) wanted to live with her husband but he was unable to take her to his place of working and due to which she committed suicide by hanging herself with the ceiling fan. In his cross-examination, P.W. 7 has stated that he did not know the name of the person who had given information to him.
Learned counsel for the State could not controvert the contention of the petitioner while opposing his prayer for bail. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge, Muzaffarpur in Sessions Trial No. 755 of 2014 arising out of Mushahari P. S. Case No. 36 of 2014 with the condition that the petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates, his bail bond would be liable to be cancelled by the learned Court concerned.
