====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-02-2021 Heard Mr. Sunil Kumar Singh, learned Advocate for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Desari P.S. Case No. 27 of 2020 dated 07.02.2020 instituted for the offences under Sections 323, 324, 307, 379, 354(B), 504, 506/34 of the Indian Penal Code.

The petitioner is said to have assaulted the informant after her two aunts were assaulted by the other accused persons.

It has been submitted on behalf of the petitioner that there is a counter version of the occurrence vide Desari P.S. Case No. 22 of 2020. The informant of this case is the niece of one Vishwanath Singh and Shivnath Singh who are accused in the

Patna High Court CR. MISC. No.32337 of 2020(2) dt.09-02-2021 2/2 aforesaid counter case. Vishwanath Singh is a witness in the present FIR. The injuries suffered by the informant have been reported to be simple in nature caused by hard and blunt substance.

Regard being had to the nature of accusation and the fact that the petitioner is a co-villager as well as neighbour of the informant, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his/their/her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Vaishali at Hajipur in connection with Desari P.S. Case No. 27 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
