JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-02-2022 Heard Mr. Prabhat Ranjan, learned counsel for the petitioner and Dr. Mrityunjay Kumar Gautam, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Belhar P.S. Case No. 145/2021 registered for the offence punishable under Section 379 of the Indian Penal Code 1860.
As per the First Information Report, 150 bags of cement has been stolen from the godown of construction site of the informant by one Vinod Yadav with the help of the petitioner.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.43095 of 2021(2) dt.03-02-2022 2/3 petitioner is Clerk/Munshi of the informant and he has falsely been implicated in this case without any material to support. He further submits that the petitioner has got no criminal antecedent and stolen bags of cement have been recovered from the house of Vinod Yadav and Umesh Chaudhary. No stolen bag of cement has been recovered from possession of the petitioner. The petitioner is in custody since 10.5.2021 and charge sheet has already been submitted.
Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 10.5.2021, charge sheet has already been submitted and no stolen cement bag has been recovered from possession of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Belhar P.S. Case No.
Patna High Court CR. MISC. No.43095 of 2021(2) dt.03-02-2022 3/3 145 of 2021.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
