The petitioner seeks bail in Turkaulia P.S. Case No. 01 of 2014, registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

The brother of the deceased alleged that his sister was killed within three years of her marriage by her husband and other in-laws.

Learned counsel for the petitioner submits that the informant did not name the petitioner in the FIR nor any allegation of demand of dowry was made against the petitioner. Admittedly the petitioner is the husband of the deceased, but he is living outside of his village.

There appears that during the course of investigation, it

Patna High Court Cr.Misc. No.49947 of 2014 (3) dt.28-04-2015 2/2 has come that the petitioner was also demanding additional dowry. Wife of the petitioner died due to strangulation within three years of her marriage.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

The petitioner is in jail since 07.03.2014, the trial court is directed to expedite the trial and conclude the same within six months from the date of receipt/production of a copy of this order holding the trial on day-to-day basis.
