The slip for listing was filed pursuant to notice dated 08th May, 2019, published prior to the vacation. The matter is, accordingly, taken up for consideration as both parties are present and willing to assist the court for disposal of the matter.

Heard counsel for the petitioner and counsel for the respondents-State.

Petitioner is claiming benefit of compassionate appointment on account of death of her husband Late Jitendra Kumar Yadav. Claim is made by relying on rule of harness and

Patna High Court CWJC No.18348 of 2018(2) dt.28-05-2019 2/2 on the ground that her husband was a constable in District Police Force, Patna.

Petitioner's counsel submits that the petitioner made application for the said benefit on 23.07.2016 but no decision has been taken on the same till date. Short submission therefore, is that authority may be directed to take final decision on the claim of the petitioner and that will satisfy grievance of the petitioner in the instant proceedings.

In view of limited grievance keeping the writ petition pending will serve no useful purpose as decision on claim for compassionate appointment has to be taken by the competent authority having regard to various parameters. Respondent no.2 (The Senior Superintendent of Police, Patna) is directed to take final decision on the petitioner's claim by reasoned and speaking order in accordance with law within three months from the date of receipt/production of a copy of this order.

Writ petition is, therefore, disposed off.
