The petitioner Suraj Singh seeks bail in K. Hat (Maranga) P.S. Case No. 512 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that the petitioner and other persons having armed with iron rods and sticks came and demanded money. Suraj Singh is alleged to have assaulted the informant with iron rod on his head.

Learned counsel for the petitioner submits that the occurrence is said to have taken place on 02.07.2014, but the FIR was lodged on 08.07.2014. The informant has stated that he was taken to primary health centre from where he was referred to Sadar Hospital, Purnea, thereafter he was referred to I.G.I.M.S.,

Patna High Court Cr.Misc. No.893 of 2015 (2) dt.09-01-2015 Patna from where he was again admitted to P.M.C.H., Patna for treatment. The informant did not lodge the case and thereafter when he returned on 08.07.2014 to his house, he lodged this case. Having considered the facts that there is inordinate delay in lodging the case and petitioner has assaulted the informant with iron rod but no injury report was produced, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Maranga) P.S. Case No. 512 of 2014.
