The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 353, 379, 385/34 of the Indian Penal Code.

As per prosecution case, on the alleged date and time of occurrence, six persons including this petitioner riding on Scorpio and other six persons were on three motorcycles came and on the point of lathi and danda took away the Haiwa. The petitioner is the owner of the said Haiwa was also involved in aforesaid act.

It is submitted by learned counsel appearing on behalf of the petitioner that no incriminating article has been recovered from the conscious possession of this petitioner. The petitioner has no concern with the alleged occurrence.

Learned APP for the State has vehemently opposed the bail of the petitioner and submits that the petitioner was also involved in the alleged occurrence.

Considering the aforesaid facts and circumstances of the case, the prayer for grant of anticipatory bail to the petitioner stands rejected.
