JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 of the Indian Penal Code and under Sections25(i-B)A/26/35 of the Arms Act. Petitioner was caught near railway godown and on search; one loaded country-made pistol was recovered. Although the informant claims that the petitioner is associate of those persons, who were caught in an Alto Car and they had come to commit dacoity but submission on behalf of petitioner is that the petitioner does not have any concern with those persons, who were caught from the Alto car. Moreover, except two cases registered under Section-420 of the Indian Penal

Patna High Court Cr.Misc. No.10081 of 2016 (2) dt.04-03-2016 2/2 Code, the petitioner does not have any criminal antecedent and is languishing in jail custody since 11-11-2015. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihar P.S.
